Probate Mediation
As with family mediation, probate mediation is a process whereby a neutral and impartial third party, leads a structured negotiation with the aim of assisting parties in a dispute to achieve a negotiated settlement.
Clients who litigate probate matters are often suffering a double whammy – a bereavement followed by the daunting prospect of court proceedings which could go on for several years whilst incurring significant legal fees.
Mediation is often well suited to probate matters. In some cases the parties may feel that they have so much to lose, they would rather reach a negotiated settlement rather than face the risk of losing everything. The uncertainty factor is removed from the equation, the price of which (giving up part of what you might have achieved at trial) may well be worth paying.
